It still doesn't negate the fact that the items are already on an auction site, regardless of what the seller says you're paying for, and therefore is in violation the EULA! Simply by advertising them on the auction site the seller is in breach of the EULA.

Remember you are paying for the time I spent on collecting these Items/Gold, not the Items/Gold themselves. All characters, items and Gold in "Guid Wars" are the sole property of NCSoft Corporation. This auction is not for the ownership of their intellectual property but it is merely for the time I spent acquiring the credits and getting them to you, all item is and will remain sole property of SOE/Lucas Arts. "Guid Wars" is a trademark of NCSoft Corporation.

Please read what i jsut said clearly before saying case closed
the reason they make that disclaimer is NOT to avoid the EULA (because it doesnt) it is because if they didnt make that disclaimer then they would be admitting they are selling the property of another corporation without authorization, and they would be liable to be sued for every penny they have.
THATS why they make those lame disclaimers.
fact of the matter is this is a moot point; if you buy gold anet can ban you, and theres a good chance they will. same goes for the vise versa. its a bad idea, period.

Not to add more kerosene, but simply because clearification is needed.

The loophole continues as follows:

Gold Farmer advertises an auction of his/her time and effort in a video game (both his/her time and effort is not legal property of ANet or NCSoft.)

Person who wants to get the easy streak in the game, negate everyone else's effort and just wants "gimmie, gimmie, gimmie!" (aka, the Ebayer) bids on said Famers time and effort.

Gold Farmer, feeling 'generous' for the Ebayer's bid, meets him in-game (as one may meet a friend) and donates an amount of gold/items.

---

That's the down and dirty process, it's not 'right' and it's not fair, but it follows all of the EULA specifics. No ANet/NCSoft property is traded/purchased.

They have pictures of Guild Wars Gold and Items, yes... but so does this site, so do many fan sites. In fact there have been several condoned instances on this site of generous players holding competitions with prizes of gold/items.

Hence, the loophole.

---

In short, don't use EBay, play the damn game.
